EBay posts strong results; cautious on holiday outlook

SAN FRANCISCO (Reuters) - EBay Inc reported strong quarterly results on Wednesday, but the e-commerce company gave a cautious forecast for the crucial holiday season amid a brewing price war between big retailers and rival Amazon.com Inc.

EBay said third-quarter revenue rose 15 percent to $3.4 billion, while profit climbed 14 percent to $718 million, or 55 cents a share, compared with 48 cents last year. The revenue matched Wall Street estimates, while profit beat by a penny.

EBay forecast fourth-quarter revenue of $3.85 billion to $4 billion and profit of 66 cents to 69 cents per share. Wall Street was looking for fourth-quarter earnings of 68 cents a share on revenue of $3.94 billion, according to Thomson Reuters I/B/E/S.

EBay shares fluctuated between small gains and losses in after-hours trading following the results.

"Not as overpowering a beat as the last couple of quarters, but they do appear on track," said Gil Luria, an analyst at Wedbush Securities.

Some analysts expected eBay to lift its fourth-quarter forecast a lot, but that did not happen.

"Given that there had been a lot of momentum in eBay and PayPal's businesses, expectations may have gotten ahead of themselves," said RJ Hottovy, an equity analyst at Morningstar.

EBay may be giving a cautious outlook for the holiday season because big retailers including Target Corp and Best Buy Co Inc are planning to match Amazon's online prices, Hottovy noted. This price tussle may put more shoppers and revenue up for grabs during the fourth quarter, he added.

"It's probably wise for eBay to err on the side of caution because of this price competition," Hottovy added.

Bob Swan, eBay's chief financial officer, told analysts during a conference call that the company expected an "OK" holiday season, with continued macro-economic pressure in Europe from the sovereign debt crisis and recession that is denting consumer demand

EBay shares have jumped so far this year, outpacing those of Amazon, on optimism that growth has resumed at the Marketplaces business and on hope for an expansion of PayPal from its online roots into physical stores.

EBay's online marketplace, one of the largest in the world, has lagged behind the growth of e-commerce and Amazon.com for several years. But under Chief Executive John Donahoe, eBay has invested to improve the buying experience by upgrading search capabilities and prodding sellers to provide more services such as free shipping and easier returns.

The explosive growth of mobile shopping has also attracted hundreds of thousands of new consumers to eBay's marketplace this year.

In the third quarter, about 800,000 shoppers made their first-ever eBay purchase through a mobile device, CEO Donahoe told analysts during the conference call.

"While I'm pleased with the acceleration, I'm not satisfied," he added. "There's no reason why our active users should not double over the next three to five years."

That growth will be driven by improvements in personalized product recommendations, expansion in countries including Brazil and Russia and chasing opportunities in local commerce, the CEO said.

EBay unveiled a redesign of its website earlier this month, which included more personalized product recommendations and faster PayPal checkout. The changes could boost sales in coming quarters, but some analysts also worry that the changes may also disrupt online shopping during the crucial holiday season.

Donahoe said on Wednesday that eBay will only roll out website changes that have already tested well with shoppers.

? One win from the World Series. Rainy or not, the Detroit Tigers will have to wait.

Game 4 of the AL championship series between the Tigers and New York Yankees was postponed because of a stormy forecast Wednesday night - although Comerica Park was still dry when the decision was made.

"They kept saying it was going to come and it never came," Tigers pitcher Max Scherzer said. "So go figure."

About an hour later, however, heavy rain started to fall, soaking the tarp that was placed on the infield before the postponement.

With the Tigers seeking a sweep in the best-of-seven series, Game 4 was rescheduled for Thursday at 4:07 p.m. New York will send ace CC Sabathia to the mound against Scherzer. The Tigers will have lefty Phil Coke, who saved Games 2 and 3, available after a day of rest.

Game 5, if necessary, would be Friday in Detroit.

Under the original schedule, there was a good chance Sabathia would pitch a potential Game 7 on three days' rest if the Yankees rallied in the series. Now, he might be limited to one start - and New York might need to win four games in four days to advance.

"You cannot think about Game 7 when you need to win a game," New York second baseman Robinson Cano said.

Yankees center fielder Curtis Granderson, benched along with third baseman Alex Rodriguez by manager Joe Girardi on Wednesday before the game was called, said the unplanned night off might actually help him and his slumping team.

"It's definitely not going to hurt by any means," Granderson said. "We haven't played well to this point. Who knows? Change is always a good thing."

The first pitch Wednesday night was slated for 8:07 p.m. But shortly before the scheduled start, the crowd was informed of a delay. A radar forecast for the Detroit area was eventually posted on the scoreboard video screen, as if to explain to fans why there was no baseball despite what was still pleasant weather at the ballpark.

The postponement was announced after a delay of about 70 minutes. A misty rain finally began about 15 minutes after the postponement was announced and steady rain followed shortly thereafter.

The Tigers are no strangers to rain in the playoffs. Last year, ace Justin Verlander had two starts cut short by bad weather - although both were on the road.

"A lot of people were pretty upset that Verlander didn't get to finish his start," Detroit catcher Alex Avila said. "So, I think people would be pretty upset if they didn't get to see Scherzer and Sabathia finish their starts as well. Major League Baseball is trying to protect not only the pitchers, but also play a clean game without having to stop and stuff like that."

After Game 1 of the 2011 ALCS at Texas was delayed twice for a total of 1 hour, 50 minutes, Game 2 was called off well before the scheduled first pitch because of a forecast calling for more wet weather. Then, it didn't rain that night.

There is also a chance of rain in Detroit during at least parts of Thursday and Friday, but the forecast calls for mostly sunny and partly cloudy skies late afternoon and early evening Thursday that would allow the teams to play ball.

(AP) ? In life, Mother Marianne Cope was known for her strength and kindness, battling bureaucrats in Hawaii as she led a group of fellow Franciscan nuns to care for leprosy patients in the islands.

And since her death 100 years ago, she has been credited with helping cure two people.

On Sunday, Mother Marianne will be declared a saint, with the Vatican formally recognizing what her supporters have long believed in their hearts: She is in heaven and that through her intercession two people were miraculously cured of ailments that should have killed them.

At the ceremony presided over by Pope Benedict XVI, the church will also canonize six others, including Kateri Tekakwitha, a 17th-century Mohawk Indian who spent most of her life in what is now upstate New York.

Bishop Larry Silva of the Honolulu diocese said the church canonizes people so adherents can be inspired by their example to go to heaven and become saints themselves.

"Our ultimate goal is to be in heaven and we know the journey there is not always easy. So we need role models, people who can inspire us through by their lives to do the same," he said.

The event comes nearly a century after Mother Marianne's 1918 death at Kalaupapa, an isolated peninsula on Molokai Island where Hawaii governments forcibly exiled leprosy patients for decades.

Mother Marianne heard the call to come to Hawaii from New York state in 1883 when she was 45. She was the only religious leader in the U.S. and Europe ? of 50 asked ? who agreed to a request by Hawaii's king and queen to come to the islands to help leprosy patients.

At the time, there was widespread fear of the disfiguring disease, which can cause skin lesions, mangled fingers and toes and lead to blindness.

The Hawaiian kingdom began exiling patients to Kalaupapa in 1866 to control the disease, a policy that remained in place until a century later even though new drugs in the 1940s made it curable.

Shortly after her arrival from Syracuse, N.Y., she had learned that a government-appointed administrator was abusing patients at Branch Hospital in Honolulu.

Mother Marianne threatened to leave with the six sisters that accompanied her unless the government removed the official. The government soon gave her full oversight of the hospital.

She treated everyone with dignity, no matter their station in life, said Sister Davilyn Ah Chick, the principal of Our Lady of Perpetual of Help School outside Honolulu.

Mother Marianne looked after the material well-being of patients by doing things like planting flowers and making clothes for children born to them. She looked after the children with particular care because the disease prevented them from touching their own mothers and fathers.

All the while, she was addressing the fear that some of the sisters had of leprosy. She had them wash their hands before they took care of patients and returned to their quarters.

"That's such a great leader who can inspire people to calm their fears and go on with their work," said Sister Patricia Burkard, past general minister of the Sisters of St. Francis of the Neumann Communities.

Mother Marianne is being canonized after the church determined that through her intercession, two people were miraculously cured.

Teenager Kate Mahoney's medically inexplicable recovery from multiple organ failure in 1993 paved the way for her beatification in 2005. Sharon Smith's successful 2005 fight against an infection that tore a hole between her intestines and stomach was the miracle needed for her to be canonized.

They were cured after friends and family prayed to Mother Marianne. In Smith's case, a sister pinned a bag of soil containing some of Mother Marianne's bone fragments to her hospital gown.

Two-hundred fifty pilgrims from Hawaii are traveling to Rome for the ceremony, among them nine Kalaupapa patients. Although cured, a dozen people still live at the peninsula, all older than 70.

It will be the second trip to Rome in three years for Hawaii pilgrims. Many made a similar trip in 2009 for the canonization of Saint Damien, a Belgian priest who moved to Kalaupapa to care for leprosy patients in 1873 and who died of the disease 16 years later.

Silva said Mother Marianne's life has many lessons for people today, even though leprosy isn't a threat anymore. Her example can be applied to other issues, such as domestic violence or homelessness.

"She is an inspiration to us to do the hard work, to not always do the glory work, but to roll up our sleeves and do what needs to be done for the sake of our brothers and sisters," Silva said.

What is Doodling? Inspired by a Spiral Staircase

Imagine what a doodle drawing based on the image linked to this article would look like. What is doodling? It could be a drawing based on this spiral idea.

Would you like to have a go at doing a doodle drawing based on this photo of a spiral staircase? If so that'd be great. If you don't have the time or inclination right now I completely understand, but please read on and the principles here may help you for another drawing or sculpting project at a later date.

A Useful Mindset

You don't have to think in terms of producing a copy of this image. Simply view the image for a while, take it in and take the time to appreciate it. Describe to yourself what it is you like about it, color, lines, shapes and forms, dark and light. Notice the cracks and crevices. Note the textures and describe them to yourself. See the depth, height, volume and space. Take your time.

Now think how you could reinterpret what you've been viewing and experiencing. The easiest and most obvious thing to do is to get into a quiet environment with pen, pencil and paper and start making marks.

If you felt more adventurous you could make a space where you could use materials such as wire, string, sticks and so on and start building or "drawing" with these materials in the open space you've set aside. Cool idea hey! And there's a whole lot more you could do with this process... That's for later.

OK, so maybe you don't have time or space for that right now so lets think back to drawing with pen, pencil, markers, crayons, pastels, charcoal, color pencils... and paper, cardboard, canvas, board, fabric.

Just let yourself express while thinking about what you liked about this image.

There is an important thing to keep at the forefront of your mind.

As I mentioned earlier, your not trying to replicate this image, unless that's what you'd really like to do, but I don't recommend replicating or copying for the purpose of what we're doing here. Rather, the image is triggering in you a response and you are the author now. You've done your viewing of the image, now it's time to move away from it and start drawing. How it comes out is up to you completely and how it comes out will be a unique expression that has it's own unique value. Even what you may think are mistakes are not really mistakes, they are part of the process of you expressing from your unique view of life and the world around you.

There are no mistakes, simply the revealing of a process you went through to produce a reinterpretation of something you were inspired by, in this case an image of an architectural design and construction using the spiral. Your final image may reveal your personal struggle to express your thoughts and feelings. That's part of what makes it unique and valuable.

Try to resist the urge to use a rubber unless the rubber is for the purpose of enhancing the effects of the image. And...please, at any stage of the drawing, resist that awful urge to think "this is no good" and screw it up or throw it away in the bin. It can be fun to screw up pieces of paper and see if you can throw them into the bin in one go but this isn't the time for throwing practice:) Do some throwing of screwed up pieces of news paper later or do that now to get it out of your system. It's actually really fun! You can do fun creative things with the pieces of screwed up paper as well. Another cool what is doodling conceptual project for later:)

The Finished Drawing, Signing & Notes

Once you get to the point when you feel that the drawing is finished set it aside somewhere safe. Once again, resist the urge that may come up in you to think that it's "dumb" or "a stupid drawing". It's not, and I can tell you that with confidence even though I haven't even seen what you've drawn. Why? Because you took the time to examine an image, even if only for a minute or two, and then you made the effort to react to it, to express yourself. That is important and valuable.

Make sure to sign your work and perhaps make a note on the back about the source of your inspiration. You could put brief information about the internet address of the Pinterest board and the Pinner of that pin. In this case the board is called Stairs, Doors, Windows and Paths and the Pinner is Desleigh~downunder~ Australia .... This person has put together awesome boards and pins.

If you were to take your drawing to a framer and have it framed in an appropriate frame that would enhance your image you would be amazed at how good it will look. If you have the money to do that then do it. If not consider doing it yourself as a gift to yourself and a fun project, maybe involving a friend or family member as well.

The Value of Your Work

In time that image will grow in value both for you as the author and one being reminded of your personal journey in life and what is and was important to you. And... in terms of money value, your work will increase over time.

Imagine if someone found your doodle drawing in a collection of family stuff a few decades from now. How valuable do you think your drawing would be to them? Especially if that person was your grandchild or great grandchild. Imagine too if a finder of your drawing a few decades from now was interested in checking out the internet address where the original image was that so inspired you to make this unique work. How wonderful that would be. That finder person would gain an instant window into times past. We could go on and on about this...

Baseball And Softball Sign Agreement

An agreement has been signed between the international baseball and softball federations on a joint bid?for the two federations to be?reinstated into the Olympic Games, and on a proposal on a shortened tournament in the hopes it will attract major league baseball players.

The Associated Press reports the two federations announced a memorandum of understanding (MOU) Monday to move ahead with a proposed merger, to be overseen by an eight-member joint committee.

Baseball and softball were voted off the Olympic program in 2005, and last appeared at the Beijing 2008 Summer Olympic Games. The federations are bidding to be reinstated for the 2020 Games.

The two sports are preparing a presentation to the International Olympic Committee's (IOC) Olympic Program Commission in December. The merger still needs the approval from the IBAF and ISF congresses.

Seeking the right to be female in Malaysia | MoCS

The 26-year-old began wearing women?s clothing at age 13. Thanks to plastic surgery in neighboring Thailand, a daily dose of hormones and a feminine nickname, she is able to present herself as female to the outside world.

But her official identification card ? which Malaysians must produce in dealings like job interviews ? declares that her name is Adam Shazrul Bin Mohammad Yusoff and that she is male.

The discrepancy between her appearance and her officially recognized gender presents much more than just awkward moments in Malaysia, where Shariah, or Islamic law, bans Muslim men from dressing or posing as women.

Penalties differ in individual states, but in Negri Sembilan, where the 26-year-old lives, convicted offenders may be sentenced to up to six months in prison, fined as much as 1,000 ringgit, about $325, or both.

Tired of living in fear of prosecution, the 26-year-old ? who has been arrested twice and was once fined 900 ringgit ? and three other transgender people are challenging the law in the secular courts, arguing that it violates the Malaysian Constitution, which bans discrimination based on gender and protects freedom of expression.

A verdict in their case ? the first time anyone has sought to overturn the law ? is expected next Thursday.

?It?s for freedom ? to be like everybody else, to wear what we like,? said the 26-year-old, explaining why she is taking part in the case. ?This shouldn?t happen. It?s an unjust law. We are just human beings. We are not doing anything wrong.?

Transgender people ? those who act like, dress as or feel themselves to be the sex opposite of what they were born ? say they are often ostracized in Malaysia, a Muslim-majority country where homosexual acts are also banned and punishable by caning and as much as 20 years? imprisonment.

Some states also have laws that bar Muslim women from dressing as men, but activists say the religious authorities focus mainly on those born male who wear women?s clothes.

Across the Asia-Pacific region, transgender people are subject to discrimination, harassment, and verbal, sexual and physical abuse within their families, at school, in workplaces, in the provision of services and in society more broadly, according to a report released in May by the U.N. Development Program.

The report states that there could be as many as 9.5 million transgender people across the Asia Pacific region and that ?alarming numbers? of transwomen ? men who identify or present as women ? are H.I.V. positive.

Support groups say transgender people in Malaysia face considerable discrimination. They say they often struggle to find work, prompting some to turn to sex work, and that they often face abuse, sometimes by the authorities.

The 26-year-old and the three other litigants in the court case ? Mohammad Juzaili Bin Mohammad Khamis, Shukur Bin Jani and Wan Fairol Bin Wan Ismail ? have all been arrested on accusations of dressing as women.

Two of their cases are continuing, pending the outcome of the judicial review.

The four are arguing not only that the law is unconstitutional but also that it should not apply to them because they have been diagnosed with Gender Identity Disorder.

The 26-year-old, who supplements the money she earns as a makeup artist with sex work, said religious officers groped her when they arrested her.

?They were very rough,? she said, adding that she is fortunate that her family accepts her, unlike the case for some of her friends.

She said that she turned down a job offer at a bank when its managers insisted that she cut her hair short, and that she turned to sex work because it helped pay for the ?monthly maintenance? required to keep her looking female, including hormones, and allowed her to dress as she liked.

One of the other litigants, a 25-year-old makeup artist who has been fined 1,000 ringgit on three occasions for dressing as a woman, said religious officers had once punched her in the face.

She said she wanted to officially change her name and gender, because it was stressful knowing that she could be arrested at any time and jailed.

?This is not just for me,? she said of the court case.

?It?s also for the community. This is something that needs to be done. We need to highlight the existence of transpeople in this country,? she said.

The Negri Sembilan State and central government departments responsible for Islamic affairs did not respond to requests for comment.

Thilaga Sulathireh, an independent researcher and rights advocate who has helped the four take their case to court, said that there were no publicly available figures indicating the total number of Malaysian men who have been prosecuted for dressing as women but that arrests were not uncommon.

?It?s unfortunate that there are Shariah laws to do moral policing,? she said, adding that two transgender people in Malacca State have also filed for a judicial review of the law since finding out about the Negri Sembilan case.

Ms. Sulathireh said that non-Muslim men who dress as women have been fined under a civil law governing public indecency but that this was less common.

She said that although Shariah judges could exercise discretion, they generally seemed to follow a ?three-strike rule,? under which people are jailed after being arrested three times.

But that is not always the case.

Nisha Ayub was jailed for three months after her first arrest for dressing as a woman 14 years ago. Ms. Nisha, who was 20 at the time, said prison wardens forced her to walk naked in front of the male inmates.

?It?s something I can?t forget until today,? she said.

Ms. Nisha, who now works as the transgender program manager at the PT Foundation, a nongovernmental organization that provides counseling and health support for transgender people, said many were often afraid to go to hospitals because they feared discrimination from medical staff.

Support groups say a fatwa, or religious edict, issued in the 1980s that forbids Muslims from having sexual reassignment surgery has led many Malaysians to travel to Thailand for surgery.

While the current case is the first legal challenge to the law that bans men from dressing as women, several other Malaysians who were born male have sought to be legally declared women.

Last year, a court in Terengganu State rejected an application by a 26-year-old man to be legally declared a woman.

Horley Isaacs, a lawyer, said the court rejected the application of Mohammad Ashraf Hafiz Abdul Aziz to change her name to Aleesha Farhana Abdul Aziz, on the basis that ?since she didn?t have a womb she doesn?t qualify to be a woman.? Ms. Aleesha, as his client was known, died about a month after the verdict. The local news media gave the cause as heart problems, but Mr. Isaacs said he had been unable to obtain a copy of the death certificate from the hospital.

?All she asked me was ?please give me a chance to live,?? said Mr. Isaacs.

He said that although several similar court applications had failed, in 2005 a Kuala Lumpur court allowed a man who was not a Muslim to change his identity to female on his identification card.

Aston Paiva, the lawyer representing the four in the judicial review, said that if the court finds in their favor, it would mean that they, and other transgenders in Negri Sembilan, could no longer be arrested for dressing as women.

Mr. Paiva said the decision could have implications beyond Negri Sembilan because transgender people arrested in other states could use the verdict to argue their case.

Despite the Islamic law prohibiting her from dressing as a woman, the 26-year-old from Seremban says she remains a practicing Muslim. She fasts during the Islamic holy month of Ramadan and sometimes visits the mosque, where she wears men?s clothing.

She said while she knows that, according to Islam, men should not dress as women, ?this is something that is in me. This is how I feel.? ? New York Times

Not feeling the cord-cutting craze? From live sports and 24-hour news to a vast array of premium channels, most Americans are staying with cable or satellite TV for now. The problem is, aside from the lack of ? la carte channel options, TV providers also make it exceptionally difficult to watch the programming you pay for from computers and mobile devices. Enter the venerable Slingbox, which since 2005 has made it easy to "place-shift" live TV and recorded DVR content, letting you watch it on any device over the Internet when you're away from home.

Now, after a four-year hiatus, Sling Media is back with the Slingbox 500 ($299.99 direct), its first consumer product since the Slingbox Pro-HD and the somewhat misguided SlingCatcher. With the 500, the Slingbox finally includes features many fans have been clamoring for, such as full 1080p streaming and Wi-Fi support. In an age of direct Internet streaming services, parts of the way the Slingbox 500 works are beginning to feel quite dated. But if you want to get the most out of your cable or satellite TV subscription, the Slingbox 500 remains a great way to stream live TV and recorded DVR content to any of your computers or mobile devices, at home or on the go.?

Design, Connections, and Setup
With its twisted design, the Slingbox 500 looks kind of like an inspired piece of modern art. It's made entirely of matte black plastic with a textured finish that feels durable and scratch resistant.?As a coworker commented, it's no longer flat on top, so people won't be putting stuff on top and watching their Slingboxes overheat, which used to happen with the older models.

In the package, you get lots of goodies. Aside from the Slingbox itself, there's a small remote control, an AC adapter, an HDMI cable, component and composite video cables, a pair of stereo RCA audio cables, an Ethernet cable, and a printed instruction manual.?The HDMI port seems like an exciting addition at first, but thanks to encryption issues from the TV providers, it only passes through regular TV and basic cable channels like USA HD. To get around this problem, Sling Media recommends a simultaneous HDMI and component audio and video cable setup; I ended up testing with the component connection.

The Slingbox 500 also includes an internal IR blaster for controlling your cable-company-issued set-top box. This means you don't have to fiddle with the little plastic external one on a wire, as you did with older models. Sling Media says the blaster is strong enough to bounce off the walls and hit the sensor on the set-top box. If that doesn't work in your setup, the company still includes the old IR blaster on a wire in case you need it.

I tested the Slingbox 500 with a Dish Network Hopper DVR and a Samsung HDTV. From the back of the Dish Hopper, I ran both HDMI and the five component A/V cables from the output jacks to the inputs on the Slingbox 500. Then out from the Slingbox 500, I connected the existing HDMI cable (from the Dish Hopper) to the back of the TV. The Slingbox 500 took about two minutes to boot for the first time; it installed a software update during this time, which I assume was already on the Slingbox, because I hadn't yet connected it to a network.

You can connect to 802.11b/g/n networks on either the 2.4GHz or 5GHz channel. I added the Slingbox 500 to our test WPA2-encrypted 5GHz network without issue, and then picked up the new remote to control the Slingbox's new TV interface. After inputting my location and zip code, the unit scanned the connected inputs and asked about our service provider, for which I selected Dish New York. It already had the Dish Hopper in its set-top box database and loaded the appropriate remote control layout. I tested the programmed remote buttons as directed, and everything worked properly from the Slingbox remote. I had no problem bringing up the menu and channel guide, switching channels, and powering the Hopper off or on?and that was without using the external blaster cable, and while standing in front of both devices.

The bundled Slingbox 500 remote is fairly small.??It's made entirely of black plastic and is very light, but doesn't feel too flimsy.?It includes a Home button at the top, three function keys, an oversize five-way control pad, Play/Pause, Stop, and seek controls, and a numeric keypad. The rubber buttons are easy to press, although they're not backlit.

Performance
As with any streaming 1080p device, you'll want to make sure your home network is in tip top shape. As a general rule, 802.11n is better than 802.11g, and 5GHz is better than 2.4GHz. (Read How to Set Up a Wireless Router for quick tips on improving your network's speed and range.)

Slingboxes have always excelled at optimizing the quality of video against available network bandwidth. Even over Wi-Fi, the Slingbox 500 is no exception. I watched?NCIS?in HD and saw a clear, crisp picture, both over 720p and 1080p, on my ThinkPad's Chrome Web browser, with perfectly synced audio at all times. I also had little trouble changing channels and otherwise navigating the Dish Hopper's program guide.

AT&T training document suggests ISPs are gearing up to beat piracy with internet restrictions

The fact that ISPs are working with the RIAA in a bid to squash piracy is far from new. A leaked document claiming to be AT&T training materials, however, suggests that the operator is about to stop talking, and start doing. According to TorrentFreak notifications will be sent out to customers on November 28th about the change in policy, with those suspected of illicit downloads receiving an email alerting them of the possible copyright infringement. We'd previously heard of a six-stage notification system, and this, too, is mentioned here with repeat offenders facing access to "many of the most frequently visited websites" restricted. Even stranger, is the talk of having to complete an online tutorial about copyright to get the restrictions lifted. As AT&T is part of the MPAA and RIAA-backed Center for Copyright Information, it's likely that the other members (Verizon, Comcast, Time Warner Cable and Cablevision), will be prepping similar plans. We've asked AT&T for confirmation directly, but for now keep an eye on the mail.

Where's the Discussion of Trojan Horses? - NYTimes.com

The Mykonos Vase, discovered in 1961 in the Cyclades, is one of the earliest accounts of the Trojan Horse, used as a subterfuge by the Greeks to enter the city of Troy during the Trojan War. Odysseus and a platoon of 30 soldiers hid in a wooden horse that was presented to Troy, and thus were able to gain access to the heavily defended city.

Thousands of years later, it remains a thoroughly modern concept that can increasingly be found at the heart of modern warfare strategies. Find your way into the computers and networks of your enemy?s weapons and military and you can render them useless in the face of an attack.

Modern Trojan horses are computer code or vulnerabilities hidden in software or hardware that would allow a spy or an attacker to gain access to an adversaries? computers and networks.

Thus it was striking that the word ?Trojan? was not mentioned in a 52-page report issued Monday by the House Permanent Select Committee on Intelligence focusing on the activities of two giant Chinese telecommunications firms, Huawei and ZTE, which have long been suspected of having links to the Chinese government.

Recently, for example, Stuxnet, a surreptitious program that was reportedly designed by United States and Israeli intelligence agencies to target the Iranian nuclear program, had many of the properties of a highly sophisticated Trojan. The program was at the heart of a concerted effort to delay or destroy the Iranian Natanz nuclear fuel facility. The attack damaged centrifuges and may have provided a surveillance window into Iranian nuclear activities by giving Western intelligence agencies unfettered access to the desktop computers of Iranian project managers.

A striking map of the paths followed by Stuxnet infection created by researchers at Symantec, the Silicon Valley computer security firm, indicates that Stuxnet actually broke out of Natanz, rather than breaking in. The program acted as a Trojan horse, perhaps delivered first on a USB memory stick, that then spread through computer networks inside the secret facility before spreading to the outside world.

Possibly that is why the term Trojan ? if it exists in the House report on Huawei and ZTE ? is found only in what is reportedly a classified annex that has not been made openly available.

The report consists of a series of allegations about the activities of the companies, including bribery and surveillance, but little hard evidence. Reports of ?suspicious? incidents including a supposed case of ?beaconing? from Cricket, a Texas wireless operator that uses Huawei equipment, have been heatedly denied by Huawei.

?This is the problem with the issue for the last two or three years,? said Richard A. Clarke, who served at the nation?s counterterrorism czar in both the Clinton and George W. Bush administrations. ?There is a government-sponsored whispering campaign against Huawei, which we are all being asked to take on faith because the government alleges it has information but it can?t find a way of revealing that.?

If this issue is important enough, he said, there should be ways of declassifying the information. ?They?re making important accusations,? he said. ?Important accusations require important proof.?

According to several former government officials, the real issue may not be what has happened in the past but rather what might happen if Huawei gear were widely used in American telecommunications networks. Wide use of its equipment would mean that the company would have to service and fix the network, requiring extensive access for its technical personnel to telecommunications networks in the United States.

The potential consequences of such an arrangement have already demonstrated according to Mr. Clarke, who wrote in ?CyberWar: The Next Threat to National Security and What to Do About It,? that in 2007 Syrian anti-aircraft radar was rendered useless in the face of a remarkably sophisticated cyberattack by Israel. Israeli aircraft were able to destroy a Syrian nuclear reactor without any response from the country?s military.

He disputes a recent New Yorker article that asserted that the bombing attack was supported by conventional electronic warfare, which involves jamming or deceiving an enemies? radar with high-powered radio waves.

?Regular electronic warfare fills the frequencies with static and overpowers the frequencies,? he said. ?That wakes people up. That didn?t happen. The Syrians didn?t notice the jamming of their radars.?

In 2009, The New York Times reported that an American semiconductor industry executive who claimed to have direct knowledge of the operation said that technology for disabling the radars was supplied by Americans to the Israeli electronic intelligence agency, Unit 8200.

The disabling technology was given informally but with the knowledge of the American government, said the executive, who spoke on the condition of anonymity. His claim could not be independently verified, and American military, intelligence and contractors with classified clearance declined to discuss the attack.

If his account is true, it may be the real reason that the United States government has worked so hard to make sure that American computer networks are not made in China.

Rihanna has offered up provocative and/or in-your-face album titles in the past ? Good Girl Gone Bad, Rated R and Loud come to mind ? but perhaps none have been as brash as Unapologetic (out November 19), which comes accompanied with artwork featuring the bare-breasted singer covered in nothing but scribbled words. So what is she apologizing for? Being the queen of the charts? Her sexed-up image? Reportedly getting back together with abusive ex Chris Brown?

Unconsciously, what it really means is that deep down she knows that Chris is ?unapologetic? for beating her up! It is really sad and stupid for her to send this message to her fans because it tells them that it?s cool to stay with a guy who has abused you.?

Is a New Real Estate Buying Frenzy Creating a Seller's Market?

The Fed just released a report indicating the real estate market is experiencing widespread improvement.? For those who are actively buying properties right now, this should come as no surprise. With numerous investors and funds actively pursuing real estate investments, it?s not uncommon to see properties going into multiple offer situations? ? many times resulting in properties selling over list price.

While this feeding frenzy of buyers can be frustrating to compete with, it does create an interesting dynamic on the sales side.? In places like Atlanta where the demand for property is very high and the inventory is shrinking every month, it?s becoming more and more of a seller?s market (at least in certain price points).

Case in point: We had a property on the market last week that went under contract to a retail buyer almost immediately. This was a modest rehab that had been priced towards the top of the neighborhood.? Within only a few days of being listed, we received an offer well above our asking price. Having priced the property fairly high, the over-asking-price offer came as a complete surprise.?Interestingly, the agent explained to us that the buyer had been outbid on 3 previous offers and was ready to get something under contract.

It seems as though the competitive climate that has been building in the residential market is having quite an impact on retail buyers as well, not just investors. ?As such, many agents are setting an expectation to their buyers that offers need to be strong in order to have a chance of getting accepted. ?And with investors bidding properties above list in many cases, this is becoming more of a reality for buyers.

The bottom line is that for those investors that are able to obtain desirable properties at a good price, the potential for flipping is getting better and better. ?Just last month I bid on a property and was beat out by another investor who paid $10,000 over list price.? Not a week later the exact same property was back on the market for $10,000 higher than what he paid! Talk about taking advantage of a hot buying market!

Every week I talk with other investors discouraged by the lack of inventory and increasing competition. Yes, it does make it harder to acquire inventory.? However, for those investors that are spending the time and energy to find and contract on the good deals, it does make the opportunity for a quick sale (and profit) that much easier.
